By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
Volume Analytics is a dashboard platform that enables users to track and analyze content creator performance metrics across social media platforms, including TikTok and Instagram. The Service provides analytics, campaign management tools, and performance tracking capabilities.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access to or use of your account.
The Service integrates with third-party platforms including TikTok and Instagram. Your use of these integrations is subject to the respective terms of service and privacy policies of those platforms.
We are not responsible for the availability, accuracy, or reliability of data provided by third-party platforms. Third-party platforms may modify their APIs, rate limits, or data availability at any time, which may affect the functionality of our Service.
By connecting your social media accounts, you authorize us to access and retrieve data from those platforms in accordance with the permissions you grant during the OAuth authorization process.

You retain ownership of any data you upload or connect to the Service. By using the Service, you grant us a limited license to use, process, and display your data solely for the purpose of providing the Service.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any defects will be corrected. We do not guarantee the accuracy, completeness, or reliability of any data or analytics provided through the Service.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DIAL LABS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us, if any, during the twelve (12) months preceding the claim, or one hundred dollars ($100 USD), whichever is greater.
You agree to indemnify, defend, and hold harmless Dial Labs LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or violation of these Terms.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.
Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in Delaware.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service with a new "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
